Welcome to ZoneMap! These Terms of Service ("Terms") govern your use of the ZoneMap mobile application ("App") and web-based admin portal ("Portal") and related services provided by Fireguy.NET ("we," "our," or "us"). By using ZoneMap, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our App or Portal.

By downloading, installing, or using ZoneMap (including both the mobile app and web portal), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Fireguy.NET. We reserve the right to modify these Terms at any time. When we make material changes, we may require you to accept the updated Terms within the App or Portal before continued use. Your continued use of the Service after such changes constitutes acceptance of those modifications.

ZoneMap is a comprehensive system providing radio channel reference information for radio enthusiasts, emergency responders, scanner hobbyists, and communication professionals.

Mobile Application

The App allows users to:

• Store and organize radio channel information
• Access agency-specific radio lineups via Access Codes
• Sync data across multiple devices (with subscription)
• Import radio data from various sources
• View a map of waypoints (e.g., repeater sites, bases, towers) with optional on-device location for distance and direction
• Receive push notifications for alerts and important updates
• Maintain favorites and scan lists (stored locally on your device)
• Accept and acknowledge the current version of these Terms and our Privacy Policy when required

Web-Based Admin Portal

The Portal provides:

• Multi-agency management capabilities
• User account administration
• Subscription management and billing
• Map entries (waypoints) management and public waypoint sharing
• Terms of Service and Privacy Policy version management
• System configuration and settings
• Data import/export tools

Account Creation

• You may use ZoneMap with or without creating an account (limited functionality)
• Account creation requires a valid email address and password
• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate and complete information when creating an account

Account Responsibilities

• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• You may not share your account credentials with others
• We reserve the right to suspend or terminate accounts that violate these Terms

ZoneMap offers both free and paid subscription tiers:

Free Tier

• Basic app functionality and limited channel storage
• Offline mode only; no cloud sync capabilities

Paid Subscriptions

• Pro Tier: Enhanced features, cloud sync, and increased storage limits.
• Agency Tier: Full agency management, unlimited users/channels, and radio lineup sharing via Access Codes.

Pricing and Payment

• Current pricing is displayed in the App Store and on our website.
• We reserve the right to modify subscription prices at any time; changes will be communicated via the App Store or email.
• Existing subscribers will be notified of price changes before their next billing cycle.
• Payment is processed through Apple's App Store; we do not directly store credit card information.

Cancellation and Refunds

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the period.
• You may cancel at any time through your Apple account settings.
• No refunds are provided by Fireguy.NET for unused subscription periods.

Confidentiality of Access Codes: Agency Tier users utilize "Access Codes" to distribute specific radio lineups to authorized personnel.

• Prohibited Distribution: You are strictly prohibited from sharing, publishing, or posting Access Codes in unsecured public forums, social media, or open websites.
• Authorized Use: Access Codes are for the sole use of personnel directly affiliated with the agency or organization for which the code was generated.
• Accountability: If an Access Code assigned to your account or agency is found in a public forum, we will attempt to contact the Agency Admin to manually change the code; however, we reserve the right to lock or terminate the account and all associated access without refund as a last resort.

Radio Frequency Information

• Reference Only: All radio frequency information provided is for reference purposes only.
• User Responsibility: Users are solely responsible for verifying the accuracy of radio frequencies before use.
• No Guarantee: We do not guarantee the accuracy, completeness, or timeliness of any radio frequency data.

Map and Waypoint Information

• Reference Only: Map entries and waypoint data (e.g., repeater sites, bases, coordinates) are for reference only and are not intended for navigation, life-safety, or operational reliance.
• User Responsibility: Users are solely responsible for verifying waypoint locations and any use of map or location features. Location data used on-device for distance/direction is not guaranteed accurate.
• Public Waypoints: Waypoints marked public may be visible to other app users; agencies are responsible for ensuring only appropriate data is shared publicly.

Emergency Use Disclaimer

• NOT A LIFE-SAFETY DEVICE: ZoneMap is a secondary reference tool only. It is NOT a substitute for official agency-issued communication equipment or primary dispatch systems.
• No Duty of Care: We assume no duty of care or liability for the success or failure of emergency operations or communications.
• Verification Required: Users are solely responsible for verifying the accuracy of radio frequencies before use in any field operation.

User-Generated Content (UGC)

• Sole Responsibility: Users are solely responsible for ANY radio channel data they input, store, or share.
• No Endorsement: We do not pre-screen, verify, or validate any user-generated content.

Restricted and Proprietary Information

• Compliance: Users must ensure that any frequencies input comply with FCC rules and all applicable laws and licensing requirements.
• Lawful Use: Users warrant they have the legal right to use and share the data they input.
• No Sharing of Restricted Data: Users agree NOT to share classified or proprietary frequency info without explicit authority.

You agree not to use ZoneMap for:

• Violating any local, state, national, or international laws or regulations (including FCC rules).
• Sharing Access Codes with the general public or posting them in open forums.
• Using frequencies without proper licensing or authorization.
• Transmitting or storing malicious code, viruses, or harmful content.
• Attempting to gain unauthorized access to our systems or other users' accounts.
• Interfering with or disrupting the App's functionality or emergency communications.
• Using the App for commercial purposes without authorization.
• Inputting or sharing any information that violates intellectual property rights or confidentiality agreements.

Our Rights

ZoneMap and all related content (logos, code, and branding) are owned by Fireguy.NET. You may not copy or modify our property without permission.

Your Rights

You retain ownership of any data you input. You grant Fireguy.NET a worldwide, royalty-free license to store, process, and sync your data as necessary to provide the requested services.

Disclaimer of Warranties

ZoneMap is provided "as is" without warranties of any kind, including accuracy of radio information or uninterrupted service.

Limitation of Damages

To the maximum extent permitted by law, Fireguy.NET shall not be liable for direct, indirect, or incidental damages, including loss of profits, business interruption, personal injury, or damages resulting from emergency situations.

Maximum Liability

Our total liability shall not exceed the amount you paid for the App or subscription services in the twelve (12) months preceding the claim.

You agree to defend, indemnify, and hold harmless Fireguy.NET from and against any claims, damages, or legal fees arising out of:

• Your use or misuse of ZoneMap.
• Your violation of these Terms or FCC regulations.
• Any content or radio data you input, share, or make available.
• Your distribution of restricted information or Access Codes.
• Any harm or damage caused by your use of radio frequency information obtained through the App.

• Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of California.
• Arbitration: Any dispute arising from these Terms shall be resolved via binding arbitration in Los Angeles, California, rather than in court.
• Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Termination by You

• You may stop using ZoneMap at any time.
• You may request deletion of your account by emailing your request to zonemap@fireguy.net.
• Subscription cancellations must still be processed through your Apple account settings to stop future billing.
• In lieu of a deletion request, all accounts and data will automatically be deleted 30 days after subscription cancellation.

Termination by Us

We may suspend or terminate your access immediately for violations of these Terms, specifically including the unauthorized public sharing of Access Codes or illegal use of radio frequencies, subject to the remediation attempts outlined in the Access Code section.
